Terms of Service

Arabic text is the primary legal reference. These Terms apply to all Kashy platform users — merchants and consumers. By using the platform you agree to these Terms in full.

1. Acceptance of Terms

Welcome to the Kashy platform. The platform is operated by Al-Edekhar International Trade S.P.C, registered in the Sultanate of Oman under Commercial Registration No. 1521134, Activity Code 661906 — Payment System Provider.

By accessing or using the Kashy platform — whether as a website, application, or service — you confirm that you have read, understood, and agreed to these Terms and the accompanying Privacy Policy.

⚠️ Warning: If you disagree with any part of these Terms, please discontinue use of the platform immediately.

2. Definitions

Kashy / Platform — Al-Edekhar International Trade S.P.C and the digital platform operating as Kashy

Merchant — Any registered business entity subscribed to the platform to offer cashback

Consumer — Any individual using Kashy to receive cashback rewards

Cashback — A percentage of the transaction value granted to the consumer as a locked credit

Locked Credit — Balance redeemable only at the issuing merchant — non-transferable, non-cashable

Platform Fees — Fees paid by the merchant to Kashy including commission and monthly subscription

3. Service Description

Kashy operates as an instant cashback platform connecting SME merchants in Oman with their customers. Services include:

Enabling merchants to offer cashback between 1%–5% of transaction value

Recording transactions, calculating cashback, and notifying consumers instantly upon purchase

Providing a merchant dashboard to monitor customer return activity

Managing the locked credit ledger per consumer per merchant

Regulatory Note: In Phase 1, Kashy does not hold consumer funds or issue e-wallets. The platform acts solely as an accounting and tracking ledger.

4. Eligibility

Minimum Age — Merchant: 18 years | Consumer: 18 years

Residency — Merchant: Registered business in Oman | Consumer: Resident in Oman

Legal Capacity — Merchant: Authorized signatory | Consumer: Full legal capacity

Phone — Merchant: Active Omani number | Consumer: Active Omani number

5. Merchant Terms

5.1 Registration & Activation

The merchant must provide accurate and complete information at registration, including: business name, commercial registration number, and contact details. Any misleading data entitles Kashy to terminate the agreement immediately.

5.2 Merchant Obligations

Honour all cashback balances recorded in the platform upon consumer redemption request

Pay platform fees due according to the selected subscription plan

Notify Kashy immediately if the business ceases or suspends operations

Not use the platform for fraudulent purposes or in violation of Omani law

6. Consumer Terms

6.1 Consumers register with their Omani phone number. Accounts are personal and non-transferable.

6.2 Cashback is credited upon completion of a genuine purchase at a subscribed Kashy merchant, verified via the merchant QR code scan.

6.3 The consumer may use their balance as a direct discount on future purchases at the same issuing merchant only.

7. Cashback Terms

Legal Nature — Locked credit — not e-money or stored value

Maximum Rate — 5% of transaction value

Default Rate — 3% of transaction value

Transferability — Non-transferable, non-cashable

Expiry — 12 months from last transaction with issuing merchant

Notice — 30-day advance notice before expiry

Returns — Cashback not applicable on returned purchases

8. Fees & Payments

Starter (Free) — Monthly fee: 0 | Kashy commission: 10% of cashback | Benefit: Free registration

Growth — Monthly fee: 10 | Kashy commission: 5% of cashback | Benefit: Advanced analytics

Premium — Monthly fee: 30 | Kashy commission: 2% of cashback | Benefit: Dedicated account manager

Kashy fees are charged on top of the cashback amount — not deducted from consumer balance. Subscription fees are non-refundable once the monthly period begins.

9. Prohibited Conduct

Recording fictitious transactions or falsifying purchases to obtain fraudulent cashback

Creating multiple accounts for the same person or sharing account credentials

Attempting to breach or exploit platform security vulnerabilities

Using the platform for money laundering or any activity in violation of Omani law

Reselling or sublicensing Kashy services without prior written permission

10. Intellectual Property

All Kashy platform content — trade name, logo, design, code, and the merchant-locked cashback mechanism — is the exclusive property of Al-Edekhar International Trade S.P.C and is protected under the intellectual property laws of the Sultanate of Oman.

11. Privacy & Data Protection

Kashy processes personal data in accordance with the data protection regulatory framework of Oman and CBO guidelines. Personal data is never sold to third parties.

Cashback notifications may include advertisements from Kashy partners, clearly labelled [Ad], requiring explicit user consent. Opt-out is available at any time.

12. Disclaimer & Limitation of Liability

Kashy services are provided "as is" without express or implied warranties. Kashy is not liable for: merchant failure to honour cashback obligations, indirect or consequential damages, or service interruptions due to force majeure.

In all cases, Kashy's total liability to any user shall not exceed the fees actually paid during the three months preceding the alleged damage.

13. Termination & Suspension

Any user may terminate their account at any time. Unused balance remains available for 60 days from the termination request date before expiring.

Kashy reserves the right to suspend or terminate any account immediately upon breach of these Terms, non-payment of fees within 15 days, suspected fraudulent activity, or order from a competent regulatory authority.

14. Amendments

Kashy reserves the right to amend these Terms at any time. Registered users will be notified of material changes 30 days before they take effect. Continued use after amendments constitutes implied acceptance.

15. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Sultanate of Oman. Disputes shall be resolved through: (1) amicable settlement within 30 days (2) accredited mediation in Oman (3) competent courts of Muscat.
